Terms & Conditions

2. Acceptance of Terms

By submitting an enquiry, accepting a written scope note, or allowing Archivum to begin work, you confirm that you have read and agree to these Terms and Conditions. If you do not agree, please do not proceed with an engagement.

Our Services are available to individuals aged 18 and above who have the legal capacity to enter into a binding agreement under Malaysian law.


3. Service Description and Scope

Archivum provides administrative and archival records support services, including document sorting and labelling, scanning, indexing, contents index preparation, storage mapping and related tasks. All Services are described in the written scope note provided before each engagement.

Archivum's Services are administrative in nature. They do not include:

Where documents handled during a Service appear to require professional input of the above kinds, Archivum will note this in writing and identify the type of qualified professional who ordinarily handles it. It remains the Client's responsibility to engage such professionals.

Services are currently available to clients in Selangor and the wider Klang Valley. Availability for addresses outside this area is subject to confirmation.

5. Intellectual Property

All materials produced by Archivum in the course of a Service — including contents sheets, indexes, scope notes, storage maps and handover packs — are provided to the Client for their personal and family use. You may not reproduce or distribute these materials for commercial purposes without our prior written consent.

The content, design and materials on the Archivum website remain the property of Archivum. Nothing in these Terms grants you a right to use Archivum's name, logo or branding.


6. Fees and Payment

Current service fees are as follows, in Malaysian Ringgit (MYR):

Payment terms and schedules are confirmed at the time of engagement. We will not begin work until payment arrangements have been agreed in writing. Archivum reserves the right to adjust fees with reasonable notice; any agreed fee applies to the engagement it was agreed for.

Fees for additional work outside the agreed scope will be discussed and confirmed before that work begins.


7. Service-Specific Terms

7.1 First Sorting Appointment

The appointment duration is two hours from the agreed start time. If additional time is required and both parties agree to continue, additional time will be charged at an agreed rate. Original documents are returned to the Client in labelled boxes at the end of the appointment.

7.2 Institutional Records Pack Preparation

The typical project duration is three to four weeks, subject to the volume and condition of documents. Archivum will notify the Client if the timeline is likely to be materially different. Digital copies are provided to the Client; Archivum does not retain copies after the project is closed.

7.3 Records Continuity Programme

The programme runs for twelve months from the date of the first appointment. Four scheduled reviews will be arranged at approximately quarterly intervals. Destruction of superseded duplicates will only be carried out on the Client's written instruction.


8. Disclaimers

Archivum's Services are administrative and archival. Nothing we produce in the course of a Service constitutes legal advice, a legal opinion, or a statement of any right, obligation or legal requirement applicable to the Client or any third party.

The general checklists and document vocabulary sheets provided as part of certain Services are general information only. They are not a statement of what any particular family is required to produce, and requirements differ by institution and circumstance.

We provide our Services with reasonable care and skill. We do not represent that any particular outcome will follow from the use of our Services, and we do not make any representation about how any institution will respond to a document set we have prepared.


9. Limitation of Liability

To the extent permitted by Malaysian law, Archivum's liability to the Client in connection with any Service is limited to the fee paid for that Service. We are not liable for indirect, consequential or special losses, including losses arising from reliance on any general information we provide or from delays caused by factors outside our control.

Nothing in these Terms excludes or limits liability for fraud, gross negligence or any other liability that cannot be excluded or limited under Malaysian law.


10. Termination

Either party may end an engagement by giving written notice. Where a Client terminates before a Service is complete, fees are payable for work completed to the date of termination. Where Archivum terminates due to circumstances outside its control or due to a material breach by the Client, the same principle applies.

Provisions relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.


11. Dispute Resolution and Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms or an engagement will first be addressed through direct discussion between the parties. If a resolution cannot be reached informally, the parties agree to attempt mediation before initiating formal proceedings.

Any legal proceedings will be subject to the jurisdiction of the courts of Malaysia.


12. General Provisions

These Terms, together with the written scope note for each engagement, constitute the entire agreement between Archivum and the Client in relation to the relevant Service. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in effect.

A failure by either party to enforce a provision does not constitute a waiver of that provision. Neither party may assign rights or obligations under these Terms without the other party's written consent.


13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our Services after a change constitutes acceptance of the revised Terms. Where changes are material, we will take reasonable steps to notify affected clients.
